Mad Chatter ("Mad Chatter," "we," "us," or "our") provides a video calling service for creators through our mobile apps and website at madchatter.chat (the "Service").
1. Eligibility
You must be at least 13 years old — or the minimum age of digital consent where you live — and able to enter into a binding agreement, to use the Service.
2. Your account & handle
You are responsible for activity under your account and @handle, and for keeping your access credentials secure. Handles are unique and licensed to you for use of the Service; they are not sold to you. We may reclaim handles that are inactive, infringe others' rights, or violate these Terms.
3. Subscriptions, billing & renewals
- Plans. Free, Pro, and Creator, with the features and prices shown in the app and at madchatter.chat.
- Auto-renewal. Paid subscriptions renew automatically at the end of each period (monthly or annual) until you cancel. You authorize us and our payment providers to charge your payment method for each renewal.
- Billing channel. Purchases made on the web are processed by Stripe. Purchases made inside the app are processed by Apple or Google and are also subject to their terms; manage or cancel those through your App Store or Google Play account.
- Cancellation. You can cancel anytime; your access continues until the end of the current billing period.
- Refunds. Except where required by law or by the applicable app store's policy, payments are non-refundable.
- Price changes. We may change prices with notice; changes take effect on your next billing period.
4. Acceptable use
You agree not to use the Service to break the law; infringe anyone's rights; harass, abuse, or harm others; distribute malware or spam; record or share others without any required consent; or interfere with the operation or security of the Service.
5. Your content, calls & recordings
You retain ownership of the content you create, including recordings and recaps tied to your account. You grant us a limited license to host, process, and transmit that content as needed to operate the Service — for example, to connect your calls and generate recaps.
Recording is your choice and your responsibility. If you record a call, you must obtain any consent required from the other participants under the laws that apply. You are solely responsible for how you record, store, and share call content.
6. AI features
Recaps and other AI-powered features are provided "as is" and may be inaccurate or incomplete. Do not rely on them as legal, medical, financial, or verbatim records.
7. Intellectual property
The Service — including our software, brand, logo, and content, but excluding your content — is owned by Mad Chatter and protected by law. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms.
8. Third-party services
The Service relies on third-party services such as Daily.co, Stripe, Apple, Google, and RevenueCat. Their terms and privacy practices apply to their portions of the experience, and we are not responsible for third-party services.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Mad Chatter will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD $100.
11. Indemnification
You agree to indemnify and hold Mad Chatter harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — will survive.
13. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and any disputes will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date, and your continued use of the Service means you accept the updated Terms.
